Voting Terms and Conditions

The Filmfare Over The Top (OTT) Awards (“OTT Awards”) is an event organized by Worldwide Media Private Limited (“WWM”) to recognize the best content creation and creators in the dynamic digital Over The Top (“OTT”) space for Indian content shows (“Entry / Entries”) on OTT platforms (“OTT Platform(s)”). By voting in the OTT Awards, you (“Voter”) agree to be bound by and abide by the terms and conditions (“Terms”/ “Voting Rules”) governing the same which are as follows:

1. Voting is available online at https://www.filmfare.com and various other platforms, as may be determined by WWM, for the categories more particularly detailed therein.
2. Each Voter shall be eligible to cast only one vote per category. Voters shall confine their choice of nominees across categories to the Indian web original series and films released between August 1, 2019 and July 31, 2020 in accordance with the alphabetical list of eligible web-series and platform provided. Voters shall fill in the name of the web-series and the platform which is provided in the drop down menu. The rest of the fields are free text. The final nomination shall be displayed on the website https://www.filmfare.com.
3. Voting will open at https://www.filmfare.com on 23rd November 2020 and closes at on 6th December 2020. Any votes registered outside the announced voting times will not be counted. The voting times may be subject to change.
4. The Voter must be above the age of 18 (eighteen) years and a should be citizen and resident of India. The Voter hereby represents and warrants that the Voter is not under any disability, restriction, or any kind of prohibition, which shall prevent Voter from performing or adhering to any of the Terms herein and has not entered into and shall not enter into any agreement that may violate the Terms herein. The Voter shall submit his/her proof of age, if requested, to WWM as may be required by WWM to confirm the eligibility of the Voter.
5. WWM further reserves the right to make any kind of changes to the Entries at its own discretion at any given time, without notification or any reason. An Entry may also be removed at any time in case of a request (supported by a valid reason) from the OTT Platform which has submitted that particular Entry. However, the decision to consider such requests vests with WWM and WWM reserves the right to keep such reasons confidential.
6. WWM reserves the right to disqualify votes or suspend voting if it has reasonable grounds to suspect that fraudulent voting has occurred or if it considers there has been any attempt to rig/manipulate the voting. Further, such fraudulent or manipulative acts may lead to disqualification of the Entry itself. WWM has the right to substitute an alternative voting method at its absolute discretion. In case a Voter(s) is found to be in non-conformance of the voting rules, then WWM will be entitled to at its sole discretion disqualify the vote(s) received from that Voter(s). Any such decision shall be final and binding on the Voter(s) and the same shall not be disputed or challenged.
7. WWM shall not be liable to provide an explanation for disqualification of an Entry or vote(s) on any grounds whatsoever.
8. WWM will not permit or entertain any requests or claims to check / audit / challenge the current voting rules and the counting of votes or the voting mechanism. WWM’s decision in relation to all matters affecting the votes is final and binding on all parties. WWM shall not be liable to release any data / vote count in relation to any Entry or Category pertaining to the OTT Awards for any reason whatsoever.
9. WWM has the right at its sole discretion to use or not use information / votes / other data provided by the Voters / audience / participants in any manner it deems fit and the Voters / audience / participants expressly consent to such use or non-use of their information / votes / other data as the case may be and as decided by WWM.
10. Vote weightage to the Voters’ choice and the judgment of a specially appointed panel of jury (“Jury”) shall be determined by WWM at its discretion will be given.
11. The shortlisting of Entries by the Jury / WWM, declaration of Vote(s), and/or any decisions made by WWM and/or the Jury appearing on the OTT Awards, selection and declaration of the Winner shall be final and binding on all the Voter(s) and in no event shall the Voter(s) dispute the decision made by the Jury, WWM and/or its employees in connection to the same. WWM shall not be required or bound to release the names of the Jury members or the shortlisting and selection criteria for selecting the Winners.
12. WWM reserves all rights to make amendments to the existing voting rules or withdraw, change, alter, amend the voting mechanism, process of selection of Entries, Winner, Voting Rules, Period and/or OTT Awards without giving any prior notice. Any changes shall be posted on this website and shall constitute sufficient notice. It shall be the sole responsibility of the Voter(s) to review the Voting Rules and Terms, from time to time. WWM reserves the right to cancel and/or reschedule the OTT Awards and /or the subsequent selection rounds and/or extend or alter the period without assigning any reasons and/or without giving any prior intimation to the Voter(s). Such decision shall be final and binding on the Voter(s) and the same shall not be disputed and/or challenged in any manner whatsoever by the Voter(s).
13. The Voter(s) shall not in any circumstances make any claims against WWM, Jury and /or any person appearing on the OTT Awards ceremony, their employees, directors and its affiliates arising out of or relating to any and all costs, injuries, accidents, deaths, losses or damages of any kind, including, without limitation due to any technical faults or directly or indirectly, to their voting.
14. Voter(s) agree, understand and acknowledge that there is no prize/gratification for voting in the OTT Awards as detailed herein nor is there an entry free for voting. The Voting Rules shall be advertised reasonably sufficiently across the Website and each Voter fully understands the entire process and costs (if applicable) for voting. It is clarified that all costs towards voting shall be borne by the Voter solely without any recourse whatsoever to WWM.
15. WWM is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Voters in any manner whatsoever or for any reason whatsoever in connection to the OTT Awards and/or any aspect related to the voting mechanism. Each Voter in consideration of being given an opportunity to vote, agrees that the Voter shall hold harmless and indemnify the Jury and / or any celebrities appearing on the OTT Awards, WWM, its affiliates, its group companies, their employees, officers, directors or any other person from and against any claims/ injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Voter, in any manner whatsoever in connection with the votes, voting mechanism, use or non-use of any information provided by the Voter, and/or the OTT Awards and/or the Winner selected and/or any personal information submitted by the Voter and the Voter hereby waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.
16. WWM shall not be responsible and/or liable in any manner whatsoever for any network problem, breakdown of machinery, unclear network, disruption in the network, technical disruption, connection failure, electricity failure, any other reason whatsoever and/or the cost of the Internet session charged by the telecom/mobile operator etc. Any dispute in connection to the above shall be settled between the Voters and the telecom/mobile operator directly, without involving WWM. In addition, WWM shall not be liable and /or responsible in any manner whatsoever in the event of any malfunction/fault /failure in the voting mechanism including without limitation voting system/failure in the mechanism of recording votes due to any reason whatsoever including technical disruption/default in internet lines /connection and /or due to technical /technological restrictions and /or due to reasons /events/incidents beyond the commercially reasonable control of WWM.
17. Voter(s) agree to not attempt to gain unauthorized access to servers or networks connected to WWM’s services by any means, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encourage, or encouraging or assisting any other persons to circumvent or modify, any security, technology, device, or software that underlies or is part of WWM’s services.
18. WWM reserves the right to suspend any Entry and/or the Jury and/or any celebrities, host(s) or performer(s), in case it has reasonable grounds to conclude that the individual(s) have been alleged in any public domain and/or social media websites for any misconduct, sexual harassment, physical abuse, coercion in any form, criminal cases or any other reasons which may tantamount to general misconduct.
19. Other third party websites may provide information related to the voting mechanism for the OTT Awards, timelines or any other information which may be relevant to the OTT Awards, however, the content on such websites is not subject to the control of WWM, their owners may be independent from WWM and WWM does not endorse or accept any responsibility for their content and casting of votes (if any) by the Voter(s) basis such information.
20. While all attempts will be made to protect the Votes and corresponding data received from the Voters from loss and/or corruption, the Voter(s) agree and acknowledge that all system are prone to failure and hacking attempts. In the event of any data loss, WWM shall make reasonable endeavours to rectify the same and may disqualify all the votes received or conduct a re-contest or continue with whatever data available in the manner it deems is fit. WWM shall not be responsible for any damage resulting from the loss of data or action taken by WWM on account of the same. WWM will not be responsible to make good any loss or dissatisfaction suffered by the Voter on account of such loss.
21. It shall be the sole responsibility of the Voter(s) to familiarize themselves with the Terms, including amendments thereof from time to time. WWM reserves the right at its sole discretion to (i) cancel and/or postpone the OTT Awards without any prior intimation to the Voter(s); (ii) make amendments to the existing Terms and/or OTT Awards, the Categories and/or Voting Period and/or withdraw, change, alter, amend the Terms, without any notification(s) to the Voter(s); (iii) extend or curtail the voting period and /or or suspend or abandon the same at any time, without any notification(s) to the Voter(s), the Voter(s) and shall have no objection to the same whatsoever, nor shall the Voter(s) make any claims /disputes in respect of the same. You further understand and acknowledge that you shall be solely responsible to visit the website from time to time in order to be informed of any updates, revisions, curtailments, extensions, in the Terms, and/or, any abandonment or termination or postponement of the OTT Awards, and abide by the same without any recourse to WWM, its authorized representatives, and each of their employees, for any reason whatsoever.
22. Voter(s) agree and acknowledge that nothing contained in these Terms will be deemed to constitute a grant of license/ assignment and/or transfer of any rights in and to the voting mechanism, OTT Awards or any such event whatsoever from WWM in the Voter’s favour. Voter(s) agree and irrevocably acknowledge that WWM shall have the sole and exclusive right including but not limited to intellectual property rights (copyrights and trademarks) and other proprietary rights in and to the OTT Awards, format of the OTT Awards, voting mechanism and all its components whatsoever.
23. Voter(s) undertake that the Voter(s) shall not violate the rights of any third party including but not limited to privacy rights, copyrights, trademark or any other intellectual rights; shall not upload, store, collect, transmit or cause the upload, storage, collection, transmission, of any information through the website which violates any applicable laws, including, inter alia, belonging to another person; or is harmful, harassing, blasphemous, defamatory, obscene, invasive of other’s privacy, pedophilic, libelous, hateful, or racially, ethnically objectionable, disparaging, harms minors in any way, violates any law for the time being in force.
24. Voter(s) agree that Voter(s) shall not indulge in any kind of activities like spamming or either directly or indirectly, reverse engineer, decompile or disassemble, make any enhancements, modifications, customizations, changes, additions, translations, deceive or mislead about the origin of such messages which is grossly offensive or menacing in nature, or allow any kind of unfair practices such as multiple votes and affect the transparency of voting, WWM reserves the right to take appropriate action including criminal action in such an event.
25. By the act of voting, it shall be construed that the Voter(s) has waived his/her right to raise any dispute with regard to the OTT Awards and/or the voting mechanism, in any manner whatsoever. Further, by the acting of voting, the Voter(s) has granted to WWM the irrevocable right to use the Voter’s vote for purposes of the OTT Awards in accordance with these Terms.
26. Each Voter(s) hereby acknowledges and agrees that the relationship between the Voter(s) and WWM and its/their affiliated companies is not a confidential, fiduciary, or other special relationship.
27. Voter(s) acknowledges that in case any portion/clause of these Voting Rules is deemed invalid or becomes unenforceable or prohibited by the law, such portions shall be considered divisible and shall not be part of the consideration, and the remainder of these Voting Rules shall be valid and binding and of like effect as though such provision was not included herein.
28. WWM shall not be liable to any Voter in the event WWM is unable proceed with the OTT , Voting Mechanism or adhere to any of the contents of the Terms stated herein for any reason whatsoever, including owing due to acts of God, wars, blockades, hostilities, civil disturbances, riots, strikes, lock-outs, epidemics, pandemics or large scale sanitary crisis, fire, storm and flood, judgment or orders of any court of law, acts of terrorism, embargo, any force majeure events and government orders or restrictions, transmission failure or damage reasonably beyond its control, or other causes reasonably beyond its control.
29. The OTT Awards, voting mechanism and the Terms shall be governed and construed in accordance with the laws of India and competent courts in Mumbai shall have exclusive jurisdiction.
30. By the act of voting, the Voter(s) have read understood, accepted and agree to abide with all the rules and regulations of voting as set out herein and agree to be unconditionally bound by the Terms and Conditions and Privacy Policy available at https://www.filmfare.com .
